Terms of Service
These terms govern your use of the SendFast platform. Please read them carefully, as they establish the rules for sending, transporting, and securing items globally.
Last Updated: October 24, 2024
1. Acceptance of Terms
By downloading, accessing, or using the SendFast app, website, or services ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must immediately cease use of the Platform. You must be at least 18 years old and capable of forming a binding contract to use SendFast.
2. SendFast's Role as a Marketplace
SendFast is a technology platform that connects individuals or businesses looking to send items ("Senders") with individuals willing to transport them ("Travelers" or "Couriers").
SendFast is not a freight forwarder, motor carrier, airline, or logistics provider. We do not take possession of, handle, or transport your items. Any agreement for transportation is strictly between the Sender and the Traveler.
3. Strictly Prohibited Items
Senders are strictly prohibited from using SendFast to transport illegal, hazardous, or heavily regulated goods. Violating this clause will result in an immediate permanent ban and cooperation with law enforcement. Prohibited items include, but are not limited to:
- Illegal drugs and narcotics
- Firearms, weaponry, or ammunition
- Explosives and hazardous materials
- Live animals or human remains
- Counterfeit goods or stolen property
- Undeclared currency exceeding customs limits
- Perishable goods without prior consent
- Any item violating TSA or destination customs laws
4. Traveler & Courier Obligations
If you accept a delivery request as a Traveler, you acknowledge and agree to the following:
- Right to InspectYou have the explicit right and obligation to physically inspect the contents of any unsealed package before accepting it to ensure it contains no prohibited items and matches the Sender's description.
- Customs & ComplianceYou are solely responsible for declaring items at customs and complying with all international travel, import, and export laws.
5. Escrow Payments & Dispute Resolution
To protect both parties, SendFast uses an Escrow system. Senders are charged upfront, and funds are held securely by our third-party payment processor.
Release of Funds: Funds are released to the Traveler only when the delivery is confirmed via the Platform (e.g., through a QR code scan, photo proof, or mutual confirmation).
Disputes: If an item is lost, damaged, or significantly delayed, Senders may initiate a dispute within 48 hours of the expected delivery date. SendFast acts as the sole arbitrator in disputes, and our decision on releasing or refunding escrowed funds is final.
6. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENDFAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE PLATFORM.
You agree to indemnify and hold SendFast, its officers, directors, and employees harmless from any and all claims, demands, losses, liabilities, and expenses arising out of your use of the Platform, your breach of these Terms, or your violation of any laws or third-party rights (including customs violations).
